Terms of service

Last updated October 19, 2026

These terms govern your use of Hearsay — the website, web app, and related services (the "Service"). Hearsay is provided by Brinus Tech Ltd, a company registered in the United Kingdom (registered office 46 Elliotts Way, Caversham, Reading RG4 8BF, England) ("we", "us"). By creating an account or using the Service, you agree to these terms with Brinus Tech Ltd. If you use the Service for an organization, you're agreeing on its behalf.

1.The Service

Hearsay lets you create surveys (manually or with AI assistance), brand them, share them through links, channels and QR codes, optionally reward respondents with coupon codes, and analyze the responses.

We may add, change, or remove features over time. We’ll give reasonable notice before removing a feature that’s material to a paid plan.

2.Your account

You sign in with a Google account, or with an email address and password. You’re responsible for activity under your account and for keeping access to it secure.

You must be at least 16 years old, or the age of digital consent where you live, to create an account.

Give us accurate information and keep it up to date. Tell us promptly if you believe your account has been compromised.

3.Workspaces and team members

Your surveys, responses, brands and coupons live in a workspace. A workspace is usually one business, and you can create or join several. The person who creates a workspace is its owner and can invite team members, give them roles, and hand ownership to another member.

Each workspace has its own plan. The subscription is per workspace, not per person: its price covers every team member in that workspace, up to the number of team members the plan includes. Usage such as responses and coupons is counted across the whole workspace.

If a workspace moves to a plan that includes fewer team members than it has, the most recently joined team members are paused until it is upgraded again. Paused members can’t open the workspace, nothing is deleted, and the owner always keeps access.

4.Plans, trials, and payment

Each plan includes a monthly allowance of coupons and responses, shown on our pricing page. When an allowance is used up, surveys stop issuing coupons or stop taking responses until the next calendar month (UTC) or an upgrade; nothing you have collected is deleted.

Trials give temporary access to a paid plan, once per person. When a trial ends without an upgrade, the workspace returns to the Free plan limits; your existing surveys and responses stay available.

Prices are shown in pounds, US dollars or Indian rupees. Your currency is fixed at your first payment. Taxes are added where we are required to collect them.

Paid plans are billed to the workspace owner, in advance for each billing period, and renew until cancelled. Prices may change with at least 30 days’ notice before your next renewal. Except where the law requires otherwise, payments aren’t refundable.

5.Your content and respondent data

You own the surveys, questions, branding, and other content you create, and the responses you collect ("Your Content"). You give us the permissions we need to host, process, and display Your Content to operate the Service for you.

You’re responsible for Your Content and for how you collect and use responses. You must have a lawful basis to collect respondents’ information, tell respondents how their answers will be used, and not ask for sensitive data (such as health, financial, or government ID information) unless you have a clear legal basis and appropriate safeguards.

For responses you collect, you act as the controller and we act as your processor. We handle that data only to provide the Service to you, as described in our privacy policy.

6.AI features

AI features send the prompts, business context, and survey content you provide to our AI provider to generate suggestions. Don’t include personal or confidential information you don’t want processed this way.

AI output can be wrong or unsuitable. Review every generated survey before you share it; you’re responsible for what you publish.

7.AI assistants

You can connect Hearsay to a third-party AI assistant, such as Claude, ChatGPT or GitHub Copilot in VS Code. A connection reaches one workspace, with the permissions you choose when you connect.

When you use Hearsay from an assistant, the survey content, results and answers you ask for are sent to that assistant’s provider at your direction. The provider handles them under your agreement with it, not these terms, and we aren’t responsible for the assistant or its output.

Actions the assistant takes through your connection, such as creating, editing, publishing, closing or deleting a survey, are treated as yours. Check what it proposes before you approve it.

Respondents’ contact details are shared with assistants only if an owner or admin of the workspace turns that on, and you must have a lawful basis to share them. You can disconnect an assistant at any time in Integrations → Connected apps.

8.Rewards and coupons

If you offer respondents rewards, you are the sole provider of those rewards. You’re responsible for honoring coupon codes, their terms, and any applicable promotion or sweepstakes laws. We only distribute the codes you upload.

9.Acceptable use

Don’t use the Service to: collect passwords, payment card numbers, or credentials; phish, spam, or deceive people; harass or discriminate; distribute malware; infringe others’ rights; break the law; or probe, overload, or bypass the Service’s security or usage limits.

We may remove content or suspend accounts that violate these terms, and will explain why unless we’re legally prevented from doing so.

10.Cancellation and termination

You can stop using the Service and ask us to delete your account at any time. You may export your responses before you go.

We may suspend or end your access for serious or repeated breaches of these terms, or if required by law. Where reasonable, we’ll give notice first and a chance to export Your Content.

11.Disclaimers

The Service is provided "as is" and "as available". To the extent the law allows, we disclaim implied warranties such as merchantability, fitness for a particular purpose, and non-infringement. We don’t guarantee the Service will be uninterrupted or error-free.

12.Limitation of liability

To the extent the law allows, we aren’t liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose.

Nothing in these terms limits liability that can’t be limited under applicable law.

13.Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, except where the law of your country gives you the right to bring a claim where you live.

14.Changes to these terms

We may update these terms. For material changes we’ll notify you by email or in the app at least 30 days before they take effect. Continuing to use the Service after that means you accept the updated terms.
